Well it is mostly GONE. That&#8217;s right GONE, but not completely.<\/p>\n<p>AND Notaries in B.C. have been warned by their Association to not notarize any claim of right documents&#8230;.<\/p>\n<p><strong>The <em>Criminal Code<\/em> has been changed AGAIN and the &#8220;claim of right&#8221; sections have been REPEALED as of 2012.<\/strong><\/p>\n<p>You can blame the &#8220;freeman&#8221; and guys like Dean Clifford for spreading the word. LOL<\/p>\n<p style=\"padding-left: 30px;\"><span style=\"color: #ff0000;\">NOTE:\u00a0Remember &#8220;they&#8221; cannot remove rights because &#8220;they&#8221; never gave you any rights BUT &#8220;they&#8221; are bound to RESPECT the rights you have\u00a0(unwritten rights mostly).\u00a0A private person&#8217;s rights remain intact regardless of what &#8220;they&#8221; write in their &#8220;codes&#8221;. &#8220;They&#8221; deceive because they cannot deny the truth, only hide it&#8230;..<\/span><\/p>\n<p>You see, when everyday people go read the law and start using it, the guys writing the laws go &#8220;OH SHIT!&#8221; Then &#8220;they&#8221; scurry about in their posh offices and re-write and re-number the laws that we the people have discovered do exist and which actually HELP people.<\/p>\n<p>I saw this &#8220;changing the law to hide the truth&#8221; with <!--more-->the <em>Bank Act<\/em> in early 2000&#8217;s and here&#8217;s another example (of many I&#8217;m sure).<\/p>\n<p>Let&#8217;s take a look, shall we&#8230;.<\/p>\n<p><strong>If you read the new, very short section 35 and compare it to all the specific, clear sections that are repealed&#8230; has the law really changed?<\/strong><\/p>\n<p>Have you lost rights or remedies?<\/p>\n<p>Or did the law just become less clear and less specific &#8211; but does the new version still state the same principle because the principles cannot be lost, only hidden or made less clear?<\/p>\n<p>Here is the new claim of right section &#8211; now only ONE Section instead of many:<\/p>\n<h2 id=\"wb-cont\"><a title=\"http:\/\/laws-lois.justice.gc.ca\/eng\/acts\/C-46\/page-14.html#s-35.\" href=\"http:\/\/laws-lois.justice.gc.ca\/eng\/acts\/C-46\/page-14.html#s-35.\" target=\"_blank\">Criminal Code\u00a0(<abbr title=\"Revised Statutes of Canada\">R.S.C.<\/abbr>, 1985, c. C-46)<\/a>\u00a0 \u00a0<a title=\"http:\/\/laws-lois.justice.gc.ca\/PDF\/C-46.pdf\" href=\"http:\/\/laws-lois.justice.gc.ca\/PDF\/C-46.pdf\" target=\"_blank\">PDF version<\/a><\/h2>\n<h2 id=\"h-10\" style=\"padding-left: 30px;\">Defence of Property<\/h2>\n<p style=\"padding-left: 30px;\"><strong>35.<\/strong>\u00a0(1)\u00a0A person is <strong>not<\/strong> guilty of an offence if<\/p>\n<p style=\"padding-left: 60px;\">(<em>a<\/em>)\u00a0they either believe on reasonable grounds that they are in peaceable possession of property or are acting under the authority of, or lawfully assisting, a person whom they believe on reasonable grounds is in peaceable possession of property;<\/p>\n<p style=\"padding-left: 60px;\">(<em>b<\/em>)\u00a0they believe on reasonable grounds that another person<\/p>\n<p style=\"padding-left: 90px;\">(i)\u00a0is about to enter, is entering or has entered the property without being entitled by law to do so,<br \/>\n(ii)\u00a0is about to take the property, is doing so or has just done so, or<br \/>\n(iii)\u00a0is about to damage or destroy the property, or make it inoperative, or is doing so;<\/p>\n<p style=\"padding-left: 60px;\">(<em>c<\/em>)\u00a0the act that constitutes the offence is committed for the purpose of<\/p>\n<p style=\"padding-left: 90px;\">(i)\u00a0preventing the other person from entering the property, or removing that person from the property, or<br \/>\n(ii)\u00a0preventing the other person from taking, damaging or destroying the property or from making it inoperative, or retaking the property from that person; and<\/p>\n<p style=\"padding-left: 60px;\">(<em>d<\/em>)\u00a0the act committed is reasonable in the circumstances.<\/p>\n<h4 style=\"padding-left: 30px;\">No defence<\/h4>\n<p style=\"padding-left: 30px;\">(2)\u00a0Subsection <strong>(1) does not apply if<\/strong> the person who believes on reasonable grounds that they are, or who is believed on reasonable grounds to be, in peaceable possession of the property <strong>does not have a claim of right to it and the other person is entitled to it<\/strong>s possession by law.<\/p>\n<h4 style=\"padding-left: 30px;\">No defence<\/h4>\n<div style=\"padding-left: 30px;\">(3)\u00a0Subsection <strong>(1) does not apply if<\/strong> the other person is doing something that they are required or <strong>authorized by law<\/strong> to do in the administration <strong>or<\/strong> enforcement of the law, unless the person who commits the act that constitutes the offence <strong>believes on reasonable grounds that the other person is acting unlawfully<\/strong>.<br \/>\nR.S., 1985, c.
