Kinda, Sorta, Sometimes or Nope"},"content":{"rendered":"<p>I just got asked again &#8220;is my action statute barred because it&#8217;s past the six month limitation period the statute Limitation Act lays out?&#8221;.<\/p>\n<p>Yes. No. Maybe. You need to research your situation.<\/p>\n<p>Are you smart? Are you gonna read the cover of a book and assume you understand the intricacies of the story?<\/p>\n<p>Have you noticed good stories make you think one thing and then surprise you with a twist?<\/p>\n<p>Law is kinda like a fiction story&#8230;<\/p>\n<p>Think Alice In Wonderland (a book that is <a title=\"Alice goes to Yale\" href=\"http:\/\/www.law.yale.edu\/studentlife\/cdostudentslibraryjudicial.htm\" target=\"_blank\" rel=\"noopener noreferrer\">recommended reading for judges in training at Yale Law School<\/a>&#8230; that&#8217;s a CLUE!) <em>NOTE the original link in the image is not working, new link above.<\/em><\/p>\n<p style=\"text-align: center;\"><a href=\"https:\/\/private-person.com\/blog\/wp-content\/uploads\/2012\/07\/YaleLaw-AliceInWonderland.gif\"><img decoding=\"async\" class=\"aligncenter wp-image-2522 lazyload\" data-src=\"https:\/\/private-person.com\/blog\/wp-content\/uploads\/2012\/07\/YaleLaw-AliceInWonderland.gif\" alt=\"YaleLaw-AliceInWonderland\" width=\"498\" height=\"338\" src=\"data:image\/svg+xml;base64,PHN2ZyB3aWR0aD0iMSIgaGVpZ2h0PSIxIiB4bWxucz0iaHR0cDovL3d3dy53My5vcmcvMjAwMC9zdmciPjwvc3ZnPg==\" style=\"--smush-placeholder-width: 498px; --smush-placeholder-aspect-ratio: 498\/338;\" \/><\/a><\/p>\n<p>&nbsp;<\/p>\n<p>The title of any Act sounds one way, reading it SEEMS to support it BUT there are exceptions or conditions that make the WHOLE ACT IRRELEVANT &#8211; to you the private person.<\/p>\n<h2>For example:<\/h2>\n<p>Ontario <a title=\"Ontario Limitations Act\" href=\"http:\/\/beta.canlii.org\/t\/31q\" target=\"_blank\" rel=\"noopener noreferrer\">Limitations Act<\/a>\u00a0section 24 (3) and the <a title=\"Public Authorities Protection Act, RSO 1990, c P.38\" href=\"http:\/\/beta.canlii.org\/t\/2n1\" target=\"_blank\" rel=\"noopener noreferrer\">Public Authorities Protection Act, RSO 1990<\/a>\u00a0<span style=\"text-decoration: underline;\">appears<\/span> to limit\/deny an action after 6 months (the action or limitation is irrelevant &#8211; its smoke and mirrors).<\/p>\n<p>BUT, reading this decision below carfefully lays out that UNDER CERTAIN CIRCUMSTANCES the limitation period does not apply (kinda like how EVERY ACT <span style=\"text-decoration: underline;\"><em><span style=\"color: #ff0000; text-decoration: underline;\">under certain circumstances<\/span><\/em><\/span> does not apply):<\/p>\n<p><strong>IN THIS CASE NO LIMITATION PERIOD (for this Act) APPLYS IF these conditions are met:<\/strong><\/p>\n<ol>\n<li>The police officers acted OUTSIDE the scope of their duties (instant loss of protection of statute)<\/li>\n<li>The police officers acted with MALICE\u00a0(instant loss of protection of statute)<\/li>\n<li>The plaintiff <strong>was<\/strong> SUFFERING from a psychological or other incapacity that would alleviate a limitation period. (sounds like common law harm?)<\/li>\n<\/ol>\n<p>Here&#8217;s the case reference and the relevant paragraphs of this case:<\/p>\n<p><a title=\"MacKenzie v. Hamilton Police, 2011 ONSC 7371 (CanLII)\" href=\"http:\/\/beta.canlii.org\/t\/fpbgd\" target=\"_blank\" rel=\"noopener noreferrer\">MacKenzie v. Hamilton Police, 2011 ONSC 7371 (CanLII)<\/a><\/p>\n<blockquote><p>[<a name=\"par67\"><\/a>67]\u00a0\u00a0 \u00a0\u00a0 \u00a0\u00a0\u00a0I find that the action is statute barred in accordance with\u00a0<a href=\"http:\/\/beta.canlii.org\/en\/on\/laws\/stat\/so-2002-c-24-sch-b\/latest\/so-2002-c-24-sch-b.html#sec24subsec3_smooth\">s. 24 (3)<\/a>\u00a0of the\u00a0<i><a href=\"http:\/\/beta.canlii.org\/en\/on\/laws\/stat\/so-2002-c-24-sch-b\/latest\/so-2002-c-24-sch-b.html\">Limitations Act 2002<\/a><\/i>\u00a0and by the operation of the six month limitation period contained in\u00a0<a href=\"http:\/\/beta.canlii.org\/en\/on\/laws\/stat\/rso-1990-c-p38\/latest\/rso-1990-c-p38.html#sec7subsec1_smooth\">s. 7(1)<\/a>\u00a0of the\u00a0<i><a href=\"http:\/\/beta.canlii.org\/en\/on\/laws\/stat\/rso-1990-c-p38\/latest\/rso-1990-c-p38.html\">P.A.P.A.<\/a><\/i>.<\/p>\n<p>[<a name=\"par68\"><\/a>68]\u00a0\u00a0 \u00a0\u00a0 \u00a0\u00a0\u00a0I find that, <strong>even if the limitation period is rendered inapplicable<\/strong> by operation of s. 10(1) of the\u00a0<i>Limitation Act 2002<\/i>, or <strong>for any other reason<\/strong>, the plaintiff has failed to establish his claim for assault, battery or any intentional infliction of bodily harm on a balance of probabilities.<\/p><\/blockquote>\n<p>Hopefully this is food for thought and makes sense and doesn&#8217;t require further explanation.<\/p>\n<h3>This is a principle (ie. there are always conditions that must be met) that applies to ALL <strong>statute<\/strong> law Acts.<\/h3>\n<p>Find the conditions and evidence they exist&#8230; and BOOM you win. Fail to do so means you lose.<\/p>\n<p>There are conditions to get you into an Act and conditions to apply\u00a0an Act to you and conditions to limit you or not.<\/p>\n<p>Look for the conditions laid out INSIDE any Act AND in court decisions where a judge is providing his explanation of the relevant conditions and did the defendant or the plaintiff meet them&#8230;or not. There are three reasons for their existence:<\/p>\n<p>1. A plaintiff with a valid cause of action should pursue it with reasonable diligence.<\/p>\n<p>2. A defendant might have lost evidence to disprove a stale claim.<\/p>\n<p>3. A long-dormant claim has more cruelty than justice.<\/p>\n<p>4.
