But laws lose all deterrent effect if the criminal-wanna-be KNOWS that no one knows the law AND\/OR the law will never be enforced against them.<\/p>\n<p>Such is the\u00a0dilemma\u00a0we find our sad selves in now with the police, lawyers, politicians, public servants and more. &#8220;They&#8221; have operated SO LONG with impunity because no one enforced the rules against them that they are\u00a0literally\u00a0in a criminal free-for-all.<\/p>\n<p>Like misbehaving children with guns they need a time out, be grounded and in some cases spanked. This applies to every &#8220;public\/civil servant&#8221; who does wrong&#8230;. including those who do not report their fellow workers who are engaging in rules breaking and criminal acts.\u00a0<strong>You are an\u00a0accomplis if you do not actively speak out to help stop it.<\/strong> You are the first, best witness to the crimes and your silence binds you to the guilt for the crimes.<\/p>\n<p>The &#8220;superiors&#8221; who encourage lawless\u00a0behaviour\u00a0by not acting to enforce the internal policies and rules, never mind the rule of law, carry the greatest burdon of guilt and\u00a0responsibility\u00a0because your actions CAN stop such behaviour, but you choose not to. Your inaction actually encourages more lawless behaviour by your charges.<\/p>\n<p>So it falls to the private citizen to <!--more-->stand alone against the irresponsible,\u00a0bureaucratic\u00a0leaders,\u00a0criminal\u00a0agents and corrupted legal system. That&#8217;s a real old story&#8230;who is tired of it? Maybe it&#8217;s time to get serious&#8230; a whole bunch of us?<\/p>\n<p>The truth is publicly acknowledged that &#8220;they&#8221; investigate and enforce the laws\u00a0against\u00a0each other in the VERY rare instance when the crime goes public enough that &#8220;they&#8221; have to pretend to enforce the law&#8230;.which then gets dragged out over a long period of time hoping that time will wear down the injured party and fade the problem from public consciousness.<\/p>\n<p>Usually it works. Sometimes not.<\/p>\n<p>Sometimes\u00a0people actually\u00a0tenaciously\u00a0hang on against &#8220;the machine&#8221; and win a settlement, sometimes in court so there is a record, other times the victim gets an offer in private so &#8220;they&#8221; can sweep the cruel truth under the rug and not be\u00a0publicly\u00a0found guilty.<\/p>\n<p>We need to remember &#8220;they&#8221; are not a machine but a group of individuals with hopes, dreams and fears just like us and they FEAR being exposed and they FEAR being prosecuted, even if their fear of prosecution is tempered by knowing that they will be protected and even if found guilty only get a slap on the wrist for their crimes. Very few are really &#8220;evil&#8221;, many may in fact be zombies but many are just average folks trained to servitude and chained to a mortgage dreaming of that VERY generous pension, with whatever perks along the way.<\/p>\n<p>(remember government workers, who are paid very well with your money to\u00a0harass\u00a0you,\u00a0produce nothing for the economy as red tape is a burden to real business. Is there legitimate purposes and value? Yes, but probably only 20% of what is done now.)<\/p>\n<p>Crime does appear to pay if you are &#8220;in the system&#8221;.<\/p>\n<p><strong>We need to up the ante and make them feel the fear they falsely put on us by reclaiming the position of masters OVER our public servants and prosecute every infraction.\u00a0<\/strong><\/p>\n<p>No other action will wake up and create changes in the behaviours of <strong>our wayward servants<\/strong>. I guess that means <strong>we need to practice being the boss\/master to them<\/strong> and not continue acting like we are the slave\/servant to government.<\/p>\n<p><span style=\"color: #ff0000;\">Every government actor is fully liable and suable when they fail to act within the rules of law and their legislated authority. But they must be sued in their personal capacity.<\/span><\/p>\n<p>Every <strong>PUBLIC<\/strong> <span style=\"text-decoration: underline;\">SERVANT<\/span>\/\u00a0<strong>CIVIL<\/strong> <span style=\"text-decoration: underline;\">SERVANT<\/span> is ONLY protected from prosecution or civil liability\u00a0<strong>IF<\/strong>\u00a0they do their job within the boundaries of their &#8220;office&#8221;\u00a0(hey, are those different legal capacities or legal systems &#8211; one serving people\/public and the other serving the civil law defacto government???) . If they DO ANYTHING outside their permissions\/ policies\/ legislation\/ law\/ mandate or rules they are considered to be acting NOT as an &#8220;officer&#8221;, with full protections and full immunity but in their personal capacity with FULL LIABILITY, NO legal protections and you can sue &#8217;em.<\/p>\n<p style=\"padding-left: 30px;\"><em><strong>Nelles v. Ontario, [1989] 2 SCR 170<\/strong><\/em> &#8211;\u00a0<a title=\"http:\/\/canlii.ca\/t\/1ft2z\" href=\"http:\/\/canlii.ca\/t\/1ft2z\" target=\"_blank\">http:\/\/canlii.ca\/t\/1ft2z<\/a><\/p>\n<p style=\"padding-left: 30px;\"><a href=\"https:\/\/private-person.com\/blog\/wp-content\/uploads\/2012\/08\/1989canlii77.pdf\">PDF version Nelles v Ontario 1989canlii77<\/a><\/p>\n<blockquote><p>It is to be noted that the <strong>appellant chose to proceed<\/strong> against the Attorney General <strong>in his official, rather than personal, capacity<\/strong>.\u00a0 In her factum, the <strong>appellant also maintains that all of the respondents were acting, &#8220;at all material times&#8221; as agents<\/strong>\u00a0[which means not in personal capacity] of the Attorney General for Ontario, who &#8220;acted as an agent&#8221; of Her Majesty the Queen in right of Ontario.<\/p>\n<p>For the purposes of Rule 126, as McIntyre J. has indicated, <strong>we must assume that all the facts alleged by the appellant in her submissions are true.<\/strong>\u00a0 The question then, to be decided <span style=\"text-decoration: underline;\">before<\/span> the matter is allowed to go to trial, is simply:\u00a0 <strong>does the appellant&#8217;s claim disclose a reasonable cause of action?<\/strong>\u00a0[the claim by the &#8220;victim&#8221; was&#8230; at all times he acted WITHIN his office&#8230; where he has full immunity for his actions&#8230;.so no valid cause of action] This is a pure question of law, and no evidence is required for its determination.\u00a0 In fact, there is every advantage, in terms of saving the time and cost of a trial, to decide a question of law at the outset.\u00a0 This, in fact, is the very reason for the existence of Rule 126.<\/p>\n<p>In the present case, a determination that the <strong>Attorney General and Crown Attorneys enjoy absolute immunity&#8230;<\/strong><span style=\"color: #ff0000;\">[ONLY ONLY ONLY when acting WITHIN their office, NOT when they act outside the scope of their office, the &#8220;victim&#8221; admits he acted within his office&#8230;.ooopps]<\/span><\/p>\n<p>&#8230;..immunity from civil suit enjoyed by Attorneys General and Crown Attorneys is absolute <span style=\"text-decoration: underline;\"><strong>when they are acting within<\/strong><\/span> the bounds of their authority.<\/p>\n<p>&#8230;..They should be no more liable to private suits for what they say and do in the discharge of their duties than\u00a0 are the judges and jurors, to say nothing of the witnesses who testify in a case. [<strong>when they are acting within<\/strong>\u00a0the bounds of their authority]<\/p>\n<p>&#8230;..\u00a0 It has been pointed out that the <em>Proceedings Against the Crown Act<\/em> was passed to give citizens <strong>the right to sue the Crown for the tortious acts<\/strong> of its officers and servants.\u00a0 The Act also <strong>prevents suits<\/strong> against the Crown for acts of its officers or servants <strong>carried out in the <span style=\"text-decoration: underline;\">due<\/span> enforcement<\/strong> of <strong><span style=\"text-decoration: underline;\">valid<\/span><\/strong> legislation.\u00a0 <strong>The Act was not designed, however, to protect<\/strong> the officers and servants of the Crown <strong>personally<\/strong> from actions arising out of torts committed by them against members of the public, <strong><span style=\"color: #ff0000;\">whether during the course of their employment or not<\/span>,<\/strong><strong>which were <span style=\"text-decoration: underline;\">not done solely<\/span> for the due enforcement of the criminal law or the provisions of any act of the Legislature<\/strong>&#8230;.<\/p><\/blockquote>\n<p>Another case:<\/p>\n<blockquote><p>[Page 123]<\/p>\n<p><em>Per <\/em>Rand J.: To deny or revoke a permit because a citizen exercises an unchallangeable right totally irrelevant to the sale of liquor in a restaurant is <strong>beyond the scope of the discretion conferred upon the Commission<\/strong> by the <em>Alcoholic Liquor Act. <\/em><strong>What was done here was not competent to the Commission<\/strong> and <em>a fortiori <\/em>to the government or the defendant. T<strong>he act of the defendant, through the instrumentality of the Commission, <span style=\"text-decoration: underline;\">brought about a breach of an implied public statutory duty toward the plaintiff<\/span>.<\/strong> There was no immunity in the defendant from an action for damages. He was under no duty in relation to the plaintiff and his act was an intrusion upon the functions of a statutory body. <strong>His liability was, there-fore, engaged<\/strong>. <strong><span style=\"text-decoration: underline;\"><span style=\"color: #ff0000; text-decoration: underline;\">There can be no question of good faith when an act is done with an improper intent and for a purpose alien to the very statute under which the act is purported to be done.<\/span><\/span><\/strong><\/p>\n<p><em>Roncarelli v. But time and experience has taken a toll and soured their ideals because they see the legal process is NOT what it is supposed to be. It can be, but some people corrupt it. Come learn why what you have been taught about law limits you and binds you to the corruption. Would you be treated this way???\u00a0<\/em><\/strong><\/p>\n<blockquote><p><strong>Edmonton cop with alcohol in blood gets absolute discharge<\/strong><\/p>\n<p>CBC News Posted: Aug 31, 2012 8:31 AM CST<br \/>\nLast Updated: Aug 31, 2012 8:07 AM CST<\/p>\n<p>An off-duty Edmonton police officer who was caught driving with alcohol in her blood in Saskatchewan was able to walk out of court without a criminal record.<\/p>\n<p>Sgt. Cheryl Wallin had open alcohol in her SUV and a blood alcohol level that was twice the legal limit \u2014 but she left a Humboldt courtroom with an absolute discharge.<\/p>\n<p>The incident took place in July, 2010. Certified mail gives you some type of proof that you actually filed a complaint against a police officer.<\/span><\/span><span style=\"font-size: small;\"><span style=\"font-family: Georgia, 'Times New Roman';\">\u00a0If you don&#8217;t send the complaint certified mail the letter sometimes gets lost or misplaced by someone at the police department.<\/span><\/span><\/p>\n<p align=\"left\"><span style=\"font-size: small;\"><span style=\"font-family: Georgia, 'Times New Roman';\">\u00a0As soon as possible write down everything that happened. Don&#8217;t worry about sending your complaint off right away. W<\/span><\/span><span style=\"font-size: small;\"><span style=\"font-family: Georgia, 'Times New Roman';\">ait a few days and go back over your written complaint and see what you might have forgotten the first time you wrote it. There&#8217;s no need for &#8220;emotions&#8221; to be involved, when you write your complaint and the most important thing is to be truthful!<\/span><\/span><span style=\"font-size: small;\"><span style=\"font-family: Georgia, 'Times New Roman';\">\u00a0If the police catch you in a lie, your complaint won&#8217;t be credible nor will any other complaints you send in the future. Name or badge number?<\/span><\/span><\/p>\n<p align=\"left\"><span style=\"font-size: small;\"><span style=\"font-family: Georgia, 'Times New Roman';\">\u00a0<strong>What<\/strong>\u00a0the officer said or did? Was he rude, abusive or used excessive force?<br \/>\n<\/span><\/span><\/p>\n<p align=\"left\"><span style=\"font-size: small;\"><span style=\"font-family: Georgia, 'Times New Roman';\">\u00a0<strong>When<\/strong>\u00a0did it happen?\u00a0<\/span><\/span><span style=\"font-size: small;\"><span style=\"font-family: Georgia, 'Times New Roman';\">Date and time.<\/span><\/span><\/p>\n<p align=\"left\"><span style=\"font-size: small;\"><span style=\"font-family: Georgia, 'Times New Roman';\">\u00a0<strong>Where<\/strong>\u00a0did it occur? Location?<br \/>\n<\/span><\/span><\/p>\n<p align=\"left\"><span style=\"font-size: small;\"><span style=\"font-family: Georgia, 'Times New Roman';\">\u00a0<strong>How<\/strong>\u00a0did the incident occur?\u00a0<\/span><\/span><\/p>\n<p align=\"left\"><span style=\"font-size: small;\"><span style=\"font-family: Georgia, 'Times New Roman';\">\u00a0Do you have corroborating witnesses, whose story does not conflict with yours? If you have witnesses you should ask each of them to write a separate account of the incident.<\/span><\/span><\/p>\n<p align=\"left\"><span style=\"font-size: small;\"><span style=\"font-family: Georgia, 'Times New Roman';\">\u00a0Do you have any type of evidence, like pictures or a video recording? If you do, don&#8217;t send the &#8220;original&#8221; to the police, send only a copy.\u00a0<\/span><\/span><\/p>\n<p align=\"left\"><span style=\"font-size: small;\"><span style=\"font-family: Georgia, 'Times New Roman';\">\u00a0Mail the complaint &#8220;certified mail<\/span><\/span><span style=\"font-size: small;\"><span style=\"font-family: Georgia, 'Times New Roman';\">\u00a0with return receipt requested<\/span><\/span><span style=\"font-size: small;\"><span style=\"font-family: Georgia, 'Times New Roman';\">,&#8221; to Internal Affairs at the police department or the sheriffs department where the officer works. The complaint will be investigated and you should receive a letter back from the police agency on the status of your complaint. Most police complaints will be in the favor of the police officer, but the good thing is the complaint will stay on the police officers record.<\/span><\/span><\/p>\n<p align=\"left\"><span style=\"font-size: small;\"><span style=\"font-family: Georgia, 'Times New Roman';\">\u00a0The police may try and contact you by phone or mail to do a &#8220;follow up&#8221; about your complaint. Don&#8217;t answer any questions and never go down to the police station for an interview. Tell them everything they need to know is in your letter you sent and then say good bye. Stick to what you said in your complaint letter and say nothing else!<br \/>\n<\/span><\/span><\/p>\n<p align=\"left\"><span style=\"font-size: small;\"><span style=\"font-family: Georgia, 'Times New Roman';\">\u00a0There is a time limit on how long you have to file a complaint against a police officer. For minor police misconduct you may have\u00a0 only 60 days and up to 6 months for more serious allegations.<br \/>\n<\/span><\/span><\/p>\n<p align=\"left\"><span style=\"font-size: small;\"><span style=\"font-family: Georgia, 'Times New Roman';\"><span style=\"font-family: Arial, Helvetica, sans-serif; font-size: xx-small;\"><span style=\"font-family: 'Times New Roman';\"><span style=\"font-family: Verdana; font-size: medium;\"><span style=\"font-family: Georgia, 'Times New Roman'; font-size: small;\"><span style=\"font-family: Verdana;\"><span style=\"font-family: Georgia, 'Times New Roman';\"><span style=\"font-size: small;\">\u00a0If you&#8217;re interested in knowing what complaints have been filed against police officers in your\u00a0<span style=\"font-size: small;\">community<\/span>, you may request a copy of that information be sent to you from that police agency.\u00a0<\/span><span style=\"font-size: small;\">Send your request &#8220;certified mail<\/span><\/span><\/span><\/span><\/span><\/span><\/span><\/span><\/span><span style=\"font-size: small;\"><span style=\"font-family: Georgia, 'Times New Roman';\">\u00a0with return receipt requested<\/span><\/span><span style=\"font-size: small;\"><span style=\"font-family: Georgia, 'Times New Roman';\">.&#8221; Request a copy of complaints of\u00a0police officers from that agency\u00a0be mailed to you under the &#8220;Freedom of Information Act.&#8221; DON&#8217;T ever walk into a police station and ask for this information! Police officers either start acting real stupid on the subject or they get mad and start threatening you.<\/span><\/span><\/p>\n<p align=\"left\"><span style=\"font-size: small;\"><span style=\"font-family: Georgia, 'Times New Roman';\">\u00a0<\/span><\/span><span style=\"font-size: small;\"><span style=\"font-family: Georgia, 'Times New Roman';\">Never file a\u00a0complaint directly with a\u00a0police agency specially if the complaint is of a\u00a0serious nature, see an attorney! If you do plan on hiring an attorney, get one who doesn&#8217;t work in your area.\u00a0<\/span><\/span><span style=\"font-size: small;\"><span style=\"font-family: Georgia, 'Times New Roman';\">Don&#8217;t get a lawyer from your town, county or from the surrounding counties.
