If you understand common law you have a TOTALLY different understanding of law than most people including trained lawyers. Legislated Acts are a different form of law.<\/p>\n<p>Why are lawyers misunderstanding the law?<\/p>\n<p>Because lawyers are not generally trained in common law processes or principles. They learn the civil law polices, procedures that the system enforcing the legal games that are designed to trick, trap and manipulate their clients into&#8230;. well you know, you&#8217;re here!<\/p>\n<p>Finding the Acts that appear to be law is easy. Reading Acts is not tough, but there are some tricks to know. We&#8217;ll look at one right now and maybe more later&#8230;..<!--more--><\/p>\n\n<p>Here&#8217;s a quick video that is an excerpt from a course available <a title=\"3. We explore the claim of &#8220;the law says this&#8221; and by reading the law yourself you can see if that is what &#8220;an Act&#8221; actually says.<\/p>\n<p><strong>We look at the State Immunity Act&#8230;<\/strong><\/p>\n<p><iframe data-src=\"http:\/\/www.youtube.com\/embed\/RjOssjN1kwI?rel=0\" frameborder=\"0\" width=\"640\" height=\"480\" src=\"data:image\/svg+xml;base64,PHN2ZyB3aWR0aD0iMSIgaGVpZ2h0PSIxIiB4bWxucz0iaHR0cDovL3d3dy53My5vcmcvMjAwMC9zdmciPjwvc3ZnPg==\" class=\"lazyload\" data-load-mode=\"1\"><\/iframe><\/p>\n<p>&nbsp;<\/p>\n<p><span style=\"text-decoration: underline;\"><strong>Reference Links<\/strong><\/span><\/p>\n<p><a title=\"State Immunity Act (Canada)\" href=\"http:\/\/www.canlii.org\/en\/ca\/laws\/stat\/rsc-1985-c-s-18\/latest\/rsc-1985-c-s-18.html\" target=\"_blank\">State Immunity Act, RSC 1985, c S-18<\/a><\/p>\n<blockquote>\n<h6>State immunity<\/h6>\n<p><strong><a id=\"s-3.\">3.<\/a><\/strong>\u00a0(1)\u00a0Except as provided by this Act, a foreign state is immune from the jurisdiction of any court in Canada.<\/p>\n<ul>\n<li><strong><a id=\"s-4.\">4.<\/a><\/strong>\u00a0(1)\u00a0<strong>A foreign state is not immune from the jurisdiction<\/strong> of a court if the state <strong>waives<\/strong> the immunity conferred by subsection 3(1) <strong>by submitting<\/strong> to the jurisdiction of the court <strong>in accordance with subsection (2) or (4)<\/strong>.<\/li>\n<li>\n<h6>State submits to jurisdiction<\/h6>\n<p>(2)\u00a0In any proceedings before a court, a foreign state submits to the jurisdiction of the court where it<\/p>\n<p>(<em>a<\/em>)\u00a0<strong>explicitly submits<\/strong> to the jurisdiction of the court by written agreement or otherwise <strong>either before or after<\/strong> the proceedings commence;<\/p>\n<p>(<em>b<\/em>)\u00a0<strong>initiates<\/strong> the proceedings in the court; or<\/p>\n<p>(<em>c<\/em>)\u00a0<strong>intervenes<\/strong> or takes any step in the proceedings before the court.<\/li>\n<li>\n<h6>Exception<\/h6>\n<p>(3)\u00a0Paragraph (2)(<em>c<\/em>) does not apply to<\/p>\n<p>(<em>a<\/em>)\u00a0any intervention or step taken by a foreign state in proceedings before a court for the purpose of claiming immunity from the jurisdiction of the court; or<\/p>\n<p>(<em>b<\/em>)\u00a0any step taken by a foreign state in ignorance of facts entitling it to immunity if those facts could not reasonably have been ascertained before the step was taken and immunity is claimed as soon as reasonably practicable after they are ascertained. [***** ARE YOU SOVEREIGN BUT DON&#8217;T KNOW IT?]<\/li>\n<li>\n<h6>Third party proceedings and counter-claims<\/h6>\n<p>(4)<strong>\u00a0A foreign state that initiates proceedings<\/strong> in a court or that <strong>intervenes<\/strong> or <strong>takes any step in proceedings<\/strong> before a court, other than an intervention or step to which paragraph (2)(<em>c<\/em>) does not apply, <strong>submits<\/strong> to the jurisdiction of the court <strong>in respect of any third party proceedings that arise, or counter-claim<\/strong> that arises, <strong>out of the subject-matter of the proceedings initiated by the state<\/strong> or in which the state has so <strong>intervened or taken a step.<\/strong><\/li>\n<li>\n<h6>Appeal and review<\/h6>\n<p>(5)\u00a0Where, in any proceedings before a court, a foreign state submits to the jurisdiction of the court in accordance with subsection (2) or (4), that submission is deemed to be a submission by the state to the jurisdiction of such one or more courts by which those proceedings may, in whole or in part, subsequently be considered on appeal or in the exercise of supervisory jurisdiction.<\/li>\n<\/ul>\n<h6 style=\"padding-left: 30px;\">Commercial activity<\/h6>\n<p style=\"padding-left: 30px;\"><strong><a id=\"s-5.\">5.<\/a><\/strong>\u00a0<strong>A foreign state is not immune<\/strong> from the jurisdiction of a court in any <strong>proceedings that relate to any commercial activity of the foreign state<\/strong>.<\/p>\n<h6 style=\"padding-left: 30px;\">Death and property damage<\/h6>\n<p style=\"padding-left: 30px;\"><span style=\"color: #ff0000;\"><a id=\"s-6.\"><span style=\"color: #ff0000;\">6.<\/span><\/a>\u00a0A foreign state is not immune from the jurisdiction of a court in any proceedings that relate to<\/span><\/p>\n<p style=\"padding-left: 30px;\"><strong><span style=\"color: #ff0000;\">(<em>a<\/em>)\u00a0any death or personal or bodily injury, or<\/span><\/strong><\/p>\n<p style=\"padding-left: 30px;\"><span style=\"color: #ff0000;\">(<strong><em>b<\/em>)\u00a0any damage to or loss of property<\/strong><\/span><\/p>\n<p style=\"padding-left: 30px;\"><span style=\"color: #ff0000;\">that occurs in Canada.<\/span><\/p>\n<\/blockquote>\n<p>&nbsp;<\/p>\n<p><a href=\"http:\/\/scc.lexum.org\/en\/2002\/2002scc62\/2002scc62.html\" target=\"_blank\">Court Case seeking the 6a exception which was denied but would apply to the ITCCS court action<\/a><\/p>\n<blockquote><p>80\u00a0\u00a0 \u00a0 Therefore, <strong>the guiding principle in the interpretation of the s. 6(<em>a<\/em>) exception<\/strong>, more consonant with the principles of international law and with the still important principle of state immunity in international relations, is found in the French version of the provision.\u00a0 It signals the presence of a legislative intent to create <strong>an exception to state immunity which would be restricted to a class of claims arising out of a physical breach of personal integrity<\/strong>, consistent with the Quebec civil law term \u201c<em>pr\u00e9judice corporel<\/em>\u201d.\u00a0 This type of breach could conceivably cover an overlapping area between physical harm and mental injury, such as nervous stress; however, the mere deprivation of freedom and the normal consequences of lawful imprisonment, as framed by the claim, do not allow the appellant to claim an exception to the <em>State Immunity Act<\/em>&#8230;.<\/p><\/blockquote>\n<p><a href=\"http:\/\/www.hicksmorley.com\/index.php?name=News&amp;file=article&amp;sid=881&amp;catid=6\" target=\"_blank\">Another interesting case related to the &#8220;commercial Activity&#8221; exceptions.<\/a>\u00a0\u00a0\u00a0 <a href=\"https:\/\/private-person.com\/blog\/wp-content\/uploads\/2012\/07\/2011.02.04_exception.pdf\">PDF version<\/a><\/p>\n<p><strong>&#8220;negative blogger&#8221; article<\/strong><\/p>\n<p style=\"padding-left: 30px;\">http:\/\/www.genuinewitty.com\/2012\/07\/05\/still-not-convinced-kevin-annett-jason-bowman-are-lying-ive-got-more\/\u00a0\u00a0\u00a0\u00a0\u00a0 (not hot linked &#8211; cut and paste this one)<\/p>\n<p><em><strong>Update on the ITCCS court action:<\/strong><\/em><\/p>\n<p style=\"padding-left: 30px;\"><a href=\"http:\/\/www.activistpost.com\/2012\/07\/unprecedented-class-action-lawsuit.html\" target=\"_blank\">http:\/\/www.activistpost.com\/2012\/07\/unprecedented-class-action-lawsuit.html<\/a><\/p>\n<p style=\"padding-left: 30px;\"><a href=\"http:\/\/itccs.org\/\" target=\"_blank\">http:\/\/itccs.org\/<\/a><br \/>\n<\/p>\n<p>Any comment&#8230;?
