Apprehensions and Health Detention Ready To Go"},"content":{"rendered":"<p>A power to apprehend and detain a person for health reasons has been in force since\u00a0 at least 2009 (I have not checked for any earlier or direct comparison changes with today&#8217;s although the specific section 49 appears the same now as 2009).<\/p>\n<p>This Act, in combination with a &#8220;declared state of emergency&#8221;, which presently is declared, and the recent federal call for proposals on the building of new &#8220;detention facilities&#8221; makes one go, hmmmm.<\/p>\n<p>So, this is not new, but&#8230;.. will it be used more freely now, is the question&#8230;? 6\u00a0\u2014\u00a0Enforcement of Orders<\/strong><\/p>\n<h2>Conditions to be met before this Part applies<\/h2>\n<div class=\"paragWrapper\">\n<p class=\"sec2\" data-viibes-parag=\"52\" data-viibes-start=\"51\" data-viibes-end=\"50\"><span class=\"secno\"><strong>52<\/strong><\/span>\u00a0\u00a0<span class=\"canlii_section_with_subsection\">(1)<\/span>\u00a0A person <span style=\"color: #ff0000;\">must not<\/span> exercise powers under this Part in respect of a <span style=\"color: #ff0000;\">localized event<\/span> unless the person <span style=\"color: #ff0000;\">reasonably believes<\/span> that<\/p>\n<\/div>\n<p class=\"para\">(a)\u00a0the action is <span style=\"color: #ff0000;\">immediately necessary to protect public health from significant harm<\/span>, and<\/p>\n<p class=\"para\">(b)\u00a0compliance with this Act, other than this Part, or a regulation made under this Act would hinder that person from acting in a manner that would avoid or mitigate an immediate and significant risk to public health.<a id=\"sec52subsec2\" name=\"sec52subsec2\"><\/a><\/p>\n<p class=\"sub\"><span class=\"canlii_subsection\">(2)<\/span>\u00a0Subject to subsection (3), a person <span style=\"color: #ff0000;\">must not<\/span> exercise powers under this Part in respect of a <span style=\"color: #ff0000;\">regional event<\/span> unless the provincial health officer provides notice that the provincial health officer <span style=\"color: #ff0000;\">reasonably believes that at least 2 of the following criteria exist:<\/span><\/p>\n<p class=\"para\">(a)\u00a0the regional event could have a <span style=\"color: #ff0000;\">serious impact on public health<\/span>;<\/p>\n<p class=\"para\">(b)\u00a0the regional event is <span style=\"color: #ff0000;\">unusual or unexpected<\/span>;<\/p>\n<p class=\"para\">(c)\u00a0there is a<span style=\"color: #ff0000;\"> significant risk of the spread<\/span> of an infectious agent or a hazardous agent;<\/p>\n<p class=\"para\">(d)\u00a0there is a <span style=\"color: #ff0000;\">significant risk of travel or trade restrictions<\/span> as a result of the regional event.<\/p>\n<p><a id=\"sec52subsec3\" name=\"sec52subsec3\"><\/a><\/p>\n<p class=\"sub\"><span class=\"canlii_subsection\">(3)<\/span>\u00a0If the provincial health officer is not immediately available to give notice under subsection (2), a person may exercise powers under this Part until the provincial health officer becomes available.<\/p>\n<p><a id=\"sec47subsec1\" name=\"sec47subsec1\"><\/a><a id=\"sec47\" name=\"sec47\"><\/a>================<\/p>\n<div class=\"section\">\n<h4><a id=\"section47\" name=\"section47\"><\/a>Warrants<\/h4>\n<div class=\"paragWrapper\">\n<p class=\"sec2\" data-viibes-parag=\"47\" data-viibes-start=\"46\" data-viibes-end=\"45\"><span class=\"secno\"><strong>47<\/strong><\/span>\u00a0\u00a0<span class=\"canlii_section_with_subsection\">(1)<\/span>\u00a0Without notice to any person, a health officer may apply, in the manner set out in the regulations, to a justice of the peace for an order under this section.<\/p>\n<\/div>\n<p><a id=\"sec47subsec2\" name=\"sec47subsec2\"><\/a><\/p>\n<p class=\"sub\"><span class=\"canlii_subsection\">(2)<\/span>\u00a0A justice of the peace may issue a warrant in the prescribed form authorizing a health officer, or a person acting on behalf of a health officer, to enter and search a place, including a private dwelling, and take any necessary action if satisfied by evidence on oath or affirmation that it is necessary for the purposes of<\/p>\n<p class=\"para\">(a)\u00a0taking an action authorized under this Act, or<\/p>\n<p class=\"para\">(b)\u00a0determining whether an action authorized under this Act should be taken.<\/p>\n<\/div>\n<p><a id=\"sec48subsec1\" name=\"sec48subsec1\"><\/a><a id=\"sec48\" name=\"sec48\"><\/a><\/p>\n<div class=\"section\">\n<h4><a id=\"section48\" name=\"section48\"><\/a>Injunctions<\/h4>\n<div class=\"paragWrapper\">\n<p class=\"sec2\" data-viibes-parag=\"48\" data-viibes-start=\"47\" data-viibes-end=\"46\"><span class=\"secno\"><strong>48<\/strong><\/span>\u00a0\u00a0<span class=\"canlii_section_with_subsection\">(1)<\/span>\u00a0Without notice to any person, a health officer may apply, in the manner set out in the regulations, to a judge of the Supreme Court for an order under this section.<\/p>\n<\/div>\n<p><a id=\"sec48subsec2\" name=\"sec48subsec2\"><\/a><\/p>\n<p class=\"sub\"><span class=\"canlii_subsection\">(2)<\/span>\u00a0A judge of the Supreme Court may grant an injunction restraining a person from contravening, or requiring a person to comply, with<\/p>\n<p class=\"para\">(a)\u00a0a provision of this Act or a regulation made under it, or<\/p>\n<p class=\"para\">(b)\u00a0a term or condition of the person&#8217;s licence or permit issued under this Act, or an order made under this Act,<\/p>\n<p class=\"sub\">if satisfied by evidence on oath or affirmation that there has been or will be a contravention of this Act, the regulations, the licence, the permit or the order.<\/p>\n<p><a id=\"sec48subsec3\" name=\"sec48subsec3\"><\/a><\/p>\n<p class=\"sub\"><span class=\"canlii_subsection\">(3)<\/span>\u00a0A judge of the Supreme Court may order a person to do or refrain from doing those things the judge considers necessary if satisfied by evidence on oath or affirmation that the person is interfering with or obstructing, or will likely interfere with or obstruct, a person who is exercising powers or performing duties under this Act.<\/p>\n<p><a id=\"sec48subsec4\" name=\"sec48subsec4\"><\/a><\/p>\n<p class=\"sub\"><span class=\"canlii_subsection\">(4)<\/span>\u00a0A judge of the Supreme Court may grant an interim injunction or order until the outcome of an application commenced under this section.<\/p>\n<\/div>\n<p><a id=\"sec49subsec1\" name=\"sec49subsec1\"><\/a><a id=\"sec49\" name=\"sec49\"><\/a><\/p>\n<div class=\"section\">\n<h4><a id=\"section49\" name=\"section49\"><\/a>Application to court if danger to public health<\/h4>\n<div class=\"paragWrapper\">\n<p class=\"sec2\" data-viibes-parag=\"49\" data-viibes-start=\"48\" data-viibes-end=\"47\"><span class=\"secno\"><strong>49<\/strong><\/span>\u00a0\u00a0<span style=\"color: #ff0000;\"><span class=\"canlii_section_with_subsection\">(1)<\/span>\u00a0To obtain an order under this section, a medical health officer may apply, in the manner set out in the regulations and with the approval of the provincial health officer, to a judge of the Provincial Court.<\/span><\/p>\n<\/div>\n<p><span style=\"color: #ff0000;\"><a id=\"sec49subsec2\" style=\"color: #ff0000;\" name=\"sec49subsec2\"><\/a><\/span><\/p>\n<p class=\"sub\"><span style=\"color: #ff0000;\"><span class=\"canlii_subsection\">(2)<\/span>\u00a0Subject to the regulations, a judge of the Provincial Court, on receiving an application, may make an order under subsection (3) if satisfied by evidence on oath or affirmation that<\/span><\/p>\n<p class=\"para\"><span style=\"color: #ff0000;\">(a)\u00a0a person is an infected person,<\/span><\/p>\n<p class=\"para\"><span style=\"color: #ff0000;\">(b)\u00a0either<\/span><\/p>\n<p class=\"subpara\"><span style=\"color: #ff0000;\">(i)\u00a0 the person has contravened an order of the medical health officer to remain in a place or not enter a place, or<\/span><\/p>\n<p class=\"subpara\"><span style=\"color: #ff0000;\">(ii)\u00a0 an order to remain in a place or not enter a place is not practical in the circumstances, and<\/span><\/p>\n<p class=\"para\"><span style=\"color: #ff0000;\">(c)\u00a0the person, if not detained, may be a danger to public health.<\/span><\/p>\n<p><span style=\"color: #ff0000;\"><a id=\"sec49subsec3\" style=\"color: #ff0000;\" name=\"sec49subsec3\"><\/a><\/span><\/p>\n<p class=\"sub\"><span style=\"color: #ff0000;\"><span class=\"canlii_subsection\">(3)<\/span>\u00a0On being satisfied of the matters set out in subsection (2), a judge of the Provincial Court may do one or both of the following:<\/span><\/p>\n<p class=\"para\"><span style=\"color: #ff0000;\">(a)\u00a0order the detention of the person, including setting the location of detention, the terms of detention and expiry of the order, and<\/span><\/p>\n<p class=\"para\"><span style=\"color: #ff0000;\">(b)\u00a0order the person to submit to an examination, preventive measures, or any other thing necessary to ensure that the person will not be a danger to public health.<\/span><\/p>\n<p><span style=\"color: #ff0000;\"><a id=\"sec49subsec4\" style=\"color: #ff0000;\" name=\"sec49subsec4\"><\/a><\/span><\/p>\n<p class=\"sub\"><span style=\"color: #ff0000;\"><span class=\"canlii_subsection\">(4)<\/span>\u00a0For the purposes of enforcing an order made under this section, a judge of the Provincial Court may issue a warrant in the prescribed form authorizing apprehension of the person, and transportation of the person to a place.<\/span><\/p>\n<p><a id=\"sec49subsec5\" name=\"sec49subsec5\"><\/a><\/p>\n<p class=\"sub\"><span style=\"color: #ff0000;\"><span class=\"canlii_subsection\">(5)<\/span>\u00a0If a judge of the Provincial Court is not available to hear an application for the purposes of this section, a medical health officer may detain a person by signing a certificate in the prescribed form stating the reasons why the medical health officer believes the person to be a person described in subsection (2).<\/span><\/p>\n<p><span style=\"color: #ff0000;\"><a id=\"sec49subsec6\" style=\"color: #ff0000;\" name=\"sec49subsec6\"><\/a><\/span><\/p>\n<p class=\"sub\"><span style=\"color: #ff0000;\"><span class=\"canlii_subsection\">(6)<\/span>\u00a0A certificate completed under subsection (5) is authority for anyone to apprehend and detain the person, and for the transportation of that person to the place of detention stated in the certificate.<\/span><\/p>\n<p><span style=\"color: #ff0000;\"><a id=\"sec49subsec7\" style=\"color: #ff0000;\" name=\"sec49subsec7\"><\/a><\/span><\/p>\n<p class=\"sub\"><span style=\"color: #ff0000;\"><span class=\"canlii_subsection\">(7)<\/span>\u00a0If a person is detained under subsections (5) and (6), an application to continue the detention must be made to a judge of the Provincial Court under subsection (1) as soon as reasonably possible, but no later than 7 days from the start of the detention.<\/span><\/p>\n<\/div>\n<p><a id=\"sec50subsec1\" name=\"sec50subsec1\"><\/a><a id=\"sec50\" name=\"sec50\"><\/a><\/p>\n<div class=\"section\">\n<h4><a id=\"section50\" name=\"section50\"><\/a>Application to court if danger to personal health<\/h4>\n<div class=\"paragWrapper\">\n<p class=\"sec2\" data-viibes-parag=\"50\" data-viibes-start=\"49\" data-viibes-end=\"48\"><span class=\"secno\"><strong>50<\/strong><\/span>\u00a0\u00a0<span class=\"canlii_section_with_subsection\">(1)<\/span>\u00a0To obtain an order under this section, a medical health officer may apply, in the manner set out in the regulations and with the approval of the provincial health officer, to a judge of the Supreme Court.<\/p>\n<\/div>\n<p><a id=\"sec50subsec2\" name=\"sec50subsec2\"><\/a><\/p>\n<p class=\"sub\"><span class=\"canlii_subsection\">(2)<\/span>\u00a0Subject to the regulations, a judge of the Supreme Court, on receiving an application, may make an order under subsection (3) if satisfied by evidence on oath or affirmation that<\/p>\n<p class=\"para\">(a)\u00a0a person is living under conditions that are a health hazard, and<\/p>\n<p class=\"para\">(b)\u00a0continuing to reside in the place may be a danger to the person&#8217;s health.<\/p>\n<p><a id=\"sec50subsec3\" name=\"sec50subsec3\"><\/a><\/p>\n<p class=\"sub\"><span class=\"canlii_subsection\">(3)<\/span>\u00a0On being satisfied of the matters set out in subsection (2), a judge of the Supreme Court may do one or more of the following:<\/p>\n<p class=\"para\">(a)\u00a0order the person to leave a place in which he or she is residing, including putting conditions on the person&#8217;s return to the place;<\/p>\n<p class=\"para\">(b)\u00a0order the detention of the person in a facility that will provide care and maintenance to the person;<\/p>\n<p class=\"para\">(c)\u00a0suspend an order made under paragraph (b) as long as the person subject to it is residing with, and receiving care and maintenance from, another person;<\/p>\n<p class=\"para\">(d)\u00a0require the medical health officer to provide a copy of an order made under paragraph (b) to an agency designated under\u00a0section 61\u00a0(a.1) of the\u00a0<em>Adult Guardianship Act<\/em>\u00a0for the purposes of Part 3 of that Act.<\/p>\n<p><a id=\"sec50subsec4\" name=\"sec50subsec4\"><\/a><\/p>\n<p class=\"sub\"><span class=\"canlii_subsection\">(4)<\/span>\u00a0Section 49 (4)\u00a0<em>[application to court if danger to public health]<\/em>\u00a0applies for the purposes of an application under this section.<\/p>\n<\/div>\n<p><a name=\"Part_5_Emergency_Powers_84809\"><\/a><\/p>\n<p>==========<a Part Ends<a id=\"sec59\" name=\"sec59\"><\/a><\/h1>\n<div class=\"section\">\n<h1><a id=\"section59\" name=\"section59\"><\/a>When authority to act under this Part ends<\/h1>\n<div class=\"paragWrapper\">\n<p class=\"sec2\" data-viibes-parag=\"59\" data-viibes-start=\"58\" data-viibes-end=\"57\"><span class=\"secno\"><strong><span class=\"canlii_section\">59<\/span><\/strong><\/span>\u00a0 Unless otherwise expressed, the authority to act under this Part ends,<\/p>\n<\/div>\n<p class=\"para\"><strong>(a)\u00a0in the case of a <span style=\"color: #ff0000;\">localized event<\/span>, as soon as reasonably practical after the emergency has passed, or<\/strong><\/p>\n<p class=\"para\">(b)\u00a0in the case of a <span style=\"color: #ff0000;\">regional event<\/span>, when the provincial health officer provides notice that the emergency has
