City of Vancouver, Vancouver Registry, Docket No. 09-25201)<\/a><\/p>\n<p>[2]\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0Mr.\u00a0Wilson was detained by the police for a period of approximately 75 minutes until he was released on his own recognizance relating to an obstruction charge arising from the altercation. Those charges were later stayed.<\/p>\n<p>[3]\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0Mr.\u00a0Wilson sued the appellant, City of Vancouver (the \u201cCity\u201d), and the police officers in Small Claims Court, alleging that he had been assaulted by the police officers and illegally detained by them. Most of those claims were dismissed by the Small Claims Court judge after trial in late 2011. The trial judge found that while the initial detention was lawful, Mr.\u00a0Wilson was detained beyond a reasonable period of time. She assessed damages against the City for that breach at $2,000, plus incidental costs, interest and other reasonable expenses.<\/p>\n<p>[4]\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0The City now appeals the finding that Mr.\u00a0Wilson was unreasonably detained and, in the alternative, the award of damages, pursuant to the\u00a0<i>Small Claims Act<\/i>, R.S.B.C. 1996, c.\u00a0430, s.\u00a05(1) (the \u201c<i>Small Claims Act<\/i>\u201d).<\/p>\n<p><a title=\"Regina v. Fortune\" href=\"http:\/\/www.bcjustice.ca\/index.php?option=com_content&amp;view=article&amp;id=10041:r-v-fortune-ruling-on-voir-dire-re-arrest-policy-directed-officers-to-arrest-anyone-they-found-driving-while-prohibited-and-to-search-their-vehicle-regardless-&amp;catid=411:people-vs-08&amp;Itemid=1182\" target=\"_blank\" rel=\"noopener noreferrer\">Registry: Chilliwack Regina v. Matthew David James Fortune<\/a><\/p>\n<p>[1]\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0Mr.\u00a0Fortune, the accused, asserts that on August 4, 2011, two police officers unlawfully arrested and detained him and conducted incidental searches pursuant to this alleged unlawful arrest. He says the officer who arrested and detained him did so because of a policy set by the officer\u2019s RCMP superiors directing him to do so. Mr.\u00a0Fortune says the officer\u2019s actions and this policy are inconsistent with the\u00a0<i>Charter of Rights and Freedoms\u00a0<\/i>[<i>Charter<\/i>].<\/p>\n<p>[2]\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0Cst. M1 and Cst. M2, the two officers involved in Mr.\u00a0Fortune&#8217;s arrest, detention, and incidental searches, explained that this official arrest policy directed officers to arrest anyone they found driving while prohibited, and to search their vehicle; regardless of whether the officer was arresting the driver under the\u00a0<i>Criminal Code<\/i>,<i>\u00a0<\/i>R.S.C. 1985, c.\u00a0C-46<i>\u00a0<\/i>[<i>Code<\/i>] or under s.\u00a079 of the\u00a0<i>Motor Vehicle Act<\/i>R.S.B.C.\u00a01996, c.\u00a0318<i><\/i>[<i>MVA<\/i>] and regardless of the particular circumstances at the time of arrest, the officers were directed to apply the policy.<\/p>\n<p>&nbsp;<\/p>\n<p><em>(Please submit any cases you know about where people have made claims and won)<\/em><\/p>\n<p>&nbsp;<\/p>\n","protected":false},"excerpt":{"rendered":"<p>YES, you can sue and win as demonstrated by this case.
