The principles discussed are applicable to common law jurisdictions although their history may be different. Cases where judges recognize common law status are discussed.

A number of cases are addressed to demonstrate that there are two different court systems in operation and the court you get is the court you agree to. Claim common law or accept the other (civil/admiralty/martial etc.)
